Let's say an employee works with a firm for a specific amount of time and then leaves that firm on good terms. Then, the ex-employer encounters (inaccurate) information about events occuring (after employment) in that former employee's personal life which portray that ex-employee in a negative light.
The firm then contacts its former employee to let the employee know that the events it heard about will negatively affect the employee as it regards to job references. Now, here are my questions:
1. Does the firm have any right/jurisdiction to monitor its former employee's personal life?
2. Can legal action be taken against the firm now (and for what)?
3. (If no to #2) When could legal action be taken against the firm and what would be the basis of the legal action?

I used to do employee verification (college job) and all the lawsuits made it so bad that most companies will not make any statements. Most companies will only confirm dates of employment, position, approximate wage and eligibility for rehire.
