17 month OPT Extension and e-verify?
I got hired on the 28th of March, 08 so its been 11 days that I have been employed now. My co. filed for my H1-B on the 1st of April and my OPT expires on the 31st of May, 08. I want to file for the 17 month OPT extension but my employer is not currently registered in the e-verify program. Can my company enroll now and satisfy USCIS's requirements so that I can become eligible for the extension? Or did they have to be enrolled BEFORE they hired me and i started working OR did tehy have only 3 days after hiring to verify me through the program? Im so confused...simply trying to figure out if I am eligible for the extension or not if I get my employer to sign up for e-verify now...

17 month OPT Extension and e-verify?showsMan I am in the same situation as you, so are hundreds if not thousands of other people. I feel that we should be fine, one of the things that USCIS wants to achieve is attract more and more employers to the e-verify program which would eventually become a central, exhaustive electronic system for employers to check the employment authorization of prospective employees. If an employer isn't already registered i.e. hasn't been using the e-verify program to check work authorization they would probably be encouraged to do so now. It seems unlikely they would disqualify people who are employed with organizations that are not registered yet but are willing to get registered.
If you go through the 48 page pdf on the DHS website explaining the rule, it becomes pretty clear that approval for the OPT extension will be decided by whether or not the employer is signed up in E-verify, as opposed to whether or not E-verify was used to check the credentials of the employee
I am pretty sure we will get this extension, this rule was put in place essentially for people like you and me, the following document should answer all your questions:
