Does anyone know about permanent resid. process and h1 extension after 6 years?

in the permanent residency process our I-140 has been approved and as of july 1 our priority date is current, but our 6 year h1 visa expired on june 6th 2007. the lawyer filled out the papers for 3 years extension but i guess sent out late becuse our receipt date is july 9 2007. which means he sent out after our visa has expired. is it a problem? we are now in the process of sending the medical exam papers etc. ? are we out of status or what?

Yikes. Technically, yes, since you need to get approval of extension while the initial visa is valid. I don't know if they will hold it up on such a short date gap or not. However, your attorney should sweat some to fix it, given the circumstances.
