my h1b visa expires in jan 08. I spent an entire year out of the US on vacation. My question is can I recap that lost year spent abroad not working to my h1b 6 yr duration?

If your visa expires in January and you come back after that you will need a new visa and possibly a new petition. You can work up to six years in H1b status. Your status in the US can be extended through USCIS by filing a new petition. You can stay throughout that period with or without a valid visa as it's up to DHS to authorize your stay here. But if you want to travel in and out of the US you need a valid visa. After the six year period, you need to leave for a year and then you can qualify again.
