No, there is no penalty from the irs for filing late without an extension if you are owed a refund. Some states do fine you if you don't file even if you are owed a refund, Ohio is one I believe. Just make sure though that you file a return where you are owed money within 3 years of the filing due date, otherwise you can't get the refund amount. This means that refunds for tax years 2003 and before are beyond the time limit for filing and claiming a refund.

Whether you owe or are owed money by the IRS is irrelevant to the filing requirement laws. You MUST file a return or you will eventually be in deep do-do!

I'm curious, though, if you have overpaid your taxes, why would you not want that cash back? It is also not necessary to file an extension. If you are due a refund for 2006, just file and get that refund. The refund will go away by April 15, 2010 if you do not request it.
