My landlord applies any money i submit to late fees first and then once that clears, she applies the rest to my actual rent. this makes it difficult because if i have any balance left on my actual rent, the late fees continue to add up at $10 per day plus an automatic late fee of $50. My rent is $555 per month and at onetime i ended up paying over $800 in one month because i could not get her to apply the partial amount i was giving her to the actual rent. instead it went all to late fees and lockout, fees(which she kept for herself and not for the complex). i was finally able to pay off my rent after 1st paying about $300 in late fees. is this legal? can someone in this biz let me know becouse this doesnt seem right. i've been threatened to be evicted if dont pay the late fees 1st.

In my state there is currently no legal limit on late fees but there is a bill in the house to try and make it $50 maximum or 10% of the rent amount wichever is greater. I hope it passes as many people here get caught in the same situation you are describing.
