Is it legal for my landlord to apply any money i submit to late fees 1st before applying it to the a
1. late fees
2. overdue utilities
3. damages tenant is responsible for
4. attorney or court fees
5. rent, subject to late fees if 1-4 are not paid with the rent.
If you dont pay, you get evicted. I, as a landlord, dont have time to play games or chase after tenants that are late. Tenants have 30 days from the time they pay their rent, until the next month is due. That is plenty of time to save for it. Its the same with with car payments, credit cards, etc. You have 30 days in between.
Now, I do have the $50.00 late fee. But $10.00 a day after that is really excessive. No court here in MI would allow it. So I have the $50.00 late fee and after 7 days of not receiving the rent and late fee, you will be evicted. There are people out there that DO pay their bills on time.|||Based on the information you gave it would seem to be legal. When you owe late fees you owe the late fees just as much as the rent. Better to borrow and pay interest so you can pay your rent on time.
