Is it to late to start a rape case?
On June 15th, I was raped at a party.
I was intoxicated, and someone at the party thought they were doing me a favor by tucking me into a bed at the house.
The bed belongedto a mexican man who was renting a room at the house.
I do not remember much of what happened, I was barely concious.
But I remember there was a mexican flag on the wall, and a man with a spanish accent entered the room, locked the door, and had sex with me.
He told me is name and that it was his room.
I was asleep for most of it, I kept losing conciousness. But I was drunk, underage, and did NOT consent to having sex with this person.
I did not get a rape kit done the next day. It has been almost a month.
My boyfriend knows the owner of the house, so we would be able to give the location and name of the offender to the police.
Is it too late to establish a case? Would my story have any legal standing in court without physical evidence?

There is no defense to statutory rape, not consent or that you were drunk or that he thought you were legal. The only issue may be lack of physical evidence, but you can worry about that later and at least still file a police complaint now.
