We are late on our rent and because we are moving out 5 days early we owe another full months rent W

A few months ago (9 months) my wife had to quit her job due to cancer. We are now in the process of filing for chap 7.

We have NEVER been late on our rent or before now everything is becoming too much to handle.

We tried to talk to the apt and explain. I asked them if they could keep out dep of 600.00 rent is 805.00 so that I would only owe them 205.00 plus either 400.00 -if someone takes our current apartment- or 800.00 if they cannot find someone to do that. They said they wouldn't hold our dep. I know we will officially be 1 month late when we go to file next week.

We will no longer live here in 2 weeks which will be around the time we have to file. I found out recently I have to give up my car and I NEED it to get back and forth to work almost 45 mins away. I make good money there and really good health bens no where else can I get a deal like I have.

Any help would really be GREAT.

I hope you are in contact with a lawyer about your Chapter 7 filing. A lawyer is the best person to advise you regarding your rights and any ways of protecting your assets, including your car. (You don't say why you have to give it up, but if it's because the payments are behind on it too, again, talk to the lawyer!) You can contact Legal Aid if you can't afford a lawyer.
