What to do with people who owe you late fees for the rent?
My tenant was late for 5 days on her rent. According to the contract, she has to pay $48.00 per day she's late. She paid me the rent on the sixth day but did not include the $240.00 late charge. She is paying the rent on time now but she still has to pay me the late fee. I can't get hold of her on her cellphone and always leaving a message. I have lots of email reminding her of the late fees but no response. What will I do? Can I file a dispute for non payment? Can I evict her? Please, I need great opinions. Thank you.

If she is month-2-month the eviction will be a bit easier, just give her 30 days notice. Other wise start eviction proceedings

hmmm shes ignoring u seems to me yo have done everything to contact her yes u can file a dispute in court how about leaving her a message first and see if u 2 cn agree on a payment plan of the 240 maybe she cant afford it all at once if no response to that then file a 5 day demand for payment of late fees u can do that yourself without a lawyer if she doesnt respond then file for an eviction|||If she is paying the rent on time now, why not waive the late fee for this time? Or give her a discount, instead of $240, ask $120. It's much hassle to evict her, it's a long process and you will have to find new tenants. I think she has learned a lesson not to be late again. Give her a break!|||yes you can evict her, but I suggest you re-assess your late fee's to a more Court acceptable method of payment.
